MEDICRIME convention: experie nce and feature s of im pleme ntation of the provisions of the convention in Ukraine

The aim of the work is to study the experience and features of the implementation of the MEDICRIME Convention in Ukraine and to develop recommendations for improving the organization in Ukraine of counteracting the falsification of medical products.
Results. An analysis of research, both by Ukrainian scientists and foreign ones, testifies to the one-sidedness of counteracting the circulation of falsified medical products. Most studies deal only with counteracting the circulation of counterfeit medicines. Although the MEDICRIME Convention deals with other types of counterfeit pharmaceutical products, including medical devices in the form of medical devices and medical equipment. That is, without attention, including domestic scientists, the problem of the circulation of other pharmaceutical products other than medicines remained, which also negatively affected the implementation of the MEDICRIME Convention. Meanwhile, the use of the concept of “falsified medical products” in Ukrainian legislation does not comply with international legal definitions of such products. And although Ukraine was part of the 13 countries that signed the Convention on the day of its adoption, October 28, 2011, and is one of the first to ratify and enforce the Convention, de facto ratification did not take place in full.
Conclusions. That is, the study of the international mechanism to counter the falsification of medical products requires, first of all, a clear definition of the concept of «falsified medical products.» Since international practice, this term is understood not only by counterfeit medicines, but also medical devices and medical equipment. Meanwhile, if the concept of “counterfeit medicines” is defined in the Law of Ukraine “On Medicines”, then the full implementation of the MEDICRIME Convention is possible only after the legislative definition of the concepts of “counterfeit medical devices” and “counterfeit medical equipment” precisely at the level of a special law.
